Trump suggests he'll take 'sanctuary cities' case to Supreme Court

After previous setbacks to his immigration agenda, President Trump on Wednesday criticized a federal judge's ruling Tuesday that the commander-in-chief can not retaliate against so-called sanctuary cities by withholding funds, suggesting he'll take the case to the U.S. Supreme Court.

Trump signed the executive order on January 25 to cut federal funding to cities that don't cooperate with with USA immigration authorities.

The ruling, which applies nationwide, was another judicial setback for the Trump administration, which has now seen three immigration orders stopped by federal courts in its first 100 days, the daily reported.

Out of our very big country, with many choices, does everyone notice that both the "ban" case and now the "sanctuary" case is brought in the 9th Circuit, which has a bad record of being overturned (close to 80%).

He said, "They used to call this 'judge shopping!' Messy system".

Out of our very big country, with many choices, does everyone notice that both the "ban" case and now the "sanctuary" case is brought in ... Orrick does not sit on that court but his district is in the territory of the appeals court, which has ruled against one version of Trump's travel ban. U.S. District Judge Derrick Watson in Hawaii and U.S. District Judge Theodore Chuang in Maryland said comments by Trump supported the allegation that the ban was aimed at Muslims.

San Francisco and Santa Clara County filed the lawsuit, arguing that billions of dollars in funding are at risk.

The ruling did not end the government's battle against sanctuary cities and counties. But the Justice Department sent letters last week advising communities to prove they are in compliance.

But Orrick said in his ruling that the president can not set new conditions on spending approved by Congress.

The White House described Judge Orrick's decision as a gift to the criminal gangs and cartels active in the United States, adding that it empowered those involved in human and sex trafficking and put thousands of innocent lives at risk.

The administration has often criticized the 9th circuit.

Judge Orrick said that the language of the executive order made clear it sought to withhold funds beyond law enforcement.

Somerville Mayor Joe Curtatone is apparently keeping score in the ongoing skirmish between President Donald Trump and so-called sanctuary cities.

San Francisco Attorney Dennis Herrera applauded the court's order in sanctuary cities.

"The Trump administration can say all it wants, but we're beginning to see all those words of Donald Trump the candidate unravel as he tries to exercise his power as Donald Trump the president", Becerra said.
